Sub: Memorandum of Grievances / request for redressal – Reg.

                Kind attention is invited to following long pending grievances of Ministerial Officers of Central Excise & Customs, at All India level, which have not been addressed / redressed by the Board until date.  .

1.      Modification of Recruitment Rules in the cadre of ‘Executive Assistant’:

As per the recently issued ‘Recruitment Rules’ in respect of newly constituted cadre of ‘Executive Assistant’, a ‘Tax Assistant’ have to serve in the cadre of ‘Tax Assistant’ for a period of 10 years, before his / her promotion to the cadre of ‘Executive Assistant’ which is grave injustice to the presently working / newly recruited Tax Assistants, which may lead to their de-motivation  and demoralization of their upbeat talent, as the period of 10 years in the life of a youth is very precious.  Hence, it is requested that the period of 10 years may be modified and reduced to three years (as existed before cadre re-structuring), as presently followed by CBDT,  by issuing a modified Order in this connection at the earliest, which may galvanize the presently demoralized ‘Tax Assistants’ , which in turn will be beneficial to the Department in future course of time.

2.      Upgrading the Grade Pay of Administrative Officers:

Though the cadre of ‘Administrative Officers’ is a gazetted cadre, it carries a Grade Pay of Rs. 4,600/- in PB-2, which is equivalent to the Grade Pay, accorded to the cadre of ‘Inspectors’, a non-gazetted cadre. This is great injustice to the cadre of ‘Administrative Officers’.  Hence, it is requested that the Grade Pay of Rs. 4,600/- presently accorded to the cadre of ‘Administrative Officers’, may be upgraded to Rs. 4,800/- in PB-2, by granting Non-functional Grade Pay of Rs. 5400/-, after completion of four years in the same cadre, which will be equivalent to the Grade Pay presently accorded to ‘Superintendents’ which is a gazetted cadre.  This is a long pending demand of Ministerial Officers, which if accepted / granted, the existing parity of pay between Administrative Officers & Superintendents (both gazette cadres) can be removed ,which if continues will be against the principle of natural justice and a great injustice to the Officers working as ‘Administrative Officers’.

3.      Promotion to the cadre of Chief Accounts Officers:

Though numerous vacancies exist in the grade of ‘Chief Accounts Officer’ at the All India level, no Officer from the grade of ‘Administrative Officer’, has been promoted to the cadre of ‘Chief Accounts Officer’  for a long period.  It is requested that necessary action may please be taken for issuing promotion Orders to the cadre of ‘Chief Accounts Officer’ at the earliest, as many serving ‘Administrative Officers’ who are due for promotion to the cadre of ‘Chief Accounts Officers’, are retiring from Government service on attaining the age of superannuation, without getting their due promotion.

4.      Conducting ‘Confirmation Examination’ in the cadre of ‘Tax Assistant’:

As per the recent guidelines of the NACEN, Faridabad, a newly recruit ‘Tax Assistant’ has to pass the ‘confirmation examination’ in different subjects without Books, within a period of two years, failing which his due increment from two years onwards will be held up. This is causing a great inconvenience to the ‘Tax Assistants’, as they are not expected to master the departmental Rules within a short period of two years, moreover, their functions are purely of administrative nature and exposure to technical field is minimal or non-existent.  Hence, it is requested that necessary action may please be taken for conducting the confirmation examination in the cadre of ‘Tax Assistant’ with Books, as it was being done prior to cadre restructuring and also by providing them proper exposure to technical work, which will benefit all the present working / newly recruited Tax Assistants, to get their due increments within the specified period of two years.

                This issues, with the approval of the President, Karnataka Customs, Central Excise, Service Tax & LTU Ministerial Officers’ Association, Bengaluru.
